Terms and Conditions – Vehicles

You will be emailed a scheduled move-in time within 2-3 weeks before the event. Please arrive at the scheduled time for entry. Late arrivals after their scheduled time can be relocated to any location specified by the HIN Australia team, or may forfeit their event participation rights for that specific event.

This agreement, is entered by and between the Colab Events (hereinafter referred to as Promoter”), and the entity listed on the Registration form (herein referred to as Registration”), is as follows.

REGISTRATION

Promoter reserves the right to allow Registrant to register for all or part of the touring car show competition titled Hot Import Nights Australia. (Hereinafter referred to as “Event”)

PAYMENT

A non-refundable 100% payment is due upon approval of the registration form. Registrants who fail to pay in a timely manner will NOT be admitted to Event. All payments are non-transferable.

SHARING/SUBLEASING

Registrant may NOT share or sublease their space; this use includes renting, sharing, donating or in any way allowing another company or individual to display or advertise in your paid space.  Non-exhibiting Registrants will NOT be allowed to place stickers, placards or other signs anywhere at the Event. Additionally, Registrants caught sharing or subleasing vehicle space will be fined $1,000 AUD or more.

ADMISSIBLE VEHICLES

Vehicle display that are disruptive, objectionable or inappropriate in nature, as interpreted by Promoter, will be removed from event without refund. No vehicle displays are allowed to have DJ music being played during event unless authorized written approval by Promoter. Any vehicle display with models signing autographs must contact Promoter in advance for correct positioning to avoid blocking egress aisles. Failure to do so will result in Registrant’s vehicle being removed from Event.

SALE OF MERCHANDISE

Absolutely NO products may be sold from a vehicle space. Registrants found selling merchandise will be fined $1,000 AUD or more and ALL merchandise will be confiscated until the end of Event.

LATE ARRIVALS

Registrants arriving after their scheduled time can be relocated to any location specified by Promoter or may forfeit their Event participation rights for the Event.

EVENT CREDENTIALS

Registrants will receive an entry pass plus (1) one buddy pass per registered vehicle. These passes are the same as event tickets.

INSURANCE

Promoter shall not be responsible for any injuries to persons and/or any loss of or damage to any property for any reason, includes theft, unless such loss of or damage is caused by gross negligence of Promoter. Registrant is required to follow and use any of the security arrangements made by Promoter for property and valuables. The Registrant is solely responsible for any personal property at Event.

Trade vehicles is required to provide and keep in force during the show period, including move in and move out periods and the following insurance coverage:

A) Worker’s compensation and employer’s liability insurance covering its employees in the state in which the show is being held, in accordance with the statutes, rules and regulations promulgated by the state governing authorities.

B) Comprehensive general liability insurance including blanket contractual liability insurance naming Promoter as an additional insured, with limits of $2,000,000 combined single limit for bodily injury and property damage or commercial general liability insurance naming the same as additional insured with limits not less than $2,000,000 general aggregate, $2000,000 products-completed operations aggregate, $200,000 personal and advertising injury limit and $200,000 each occurrence limit.

C) All risk property insurance covering all Registrants property brought into or used in connection with the show including the move in and move out periods with insurance coverage to be set forth in an insurance policy that includes (i) a waiver of subrogation against Promoter, its members, employees, officers, and agents, and (ii) limits of liability providing minimum coverage (with no deduction or participation provisions) of not less than the full replacement cost of the property lost or damaged.

INDEMNIFICATION

Registrant shall fully indemnify, defend, and hold promoter, and all its managers, members, directors, officers, employees, agents, successors and assigns, harmless from any and all losses, damages, expenses, claims, judgements, liabilities, suits, and proceedings of any nature, whether accrued, absolute, contingent or otherwise which arise from (i) Registrant’s breach of this Agreement, (ii) any damage or deficiency resulting from misrepresentation in or omission from any document, instrument, record, statement, of certificate, furnished or to be furnished, to Promoter here-under, (iii) any act or omission of Registrant or any of its shareholders, directors, officers, employees, agents, successors, and assigns and (iv) all actions, suits, proceedings, demands, assessments, judgements, costs and expenses incident to any of the foregoing. In addition, Registrant shall reimburse to Promoter, on demand, for any payment made by Promoter in respect to liability or claim to which the foregoing indemnity relates.

COPYRIGHTS

Registrant hereby assumes all costs and expenses arising from Registrant’s or Registrants’ agents’ or employee’s incorporation or use during the event of any music, written material, dramatic rights, inventions or devices that are subject of any copyright, trademark, trade name, patent, franchise or other contractual or statutory protection. Registrant agrees to indemnify and hold harmless Promoter, its Directors, officers and employees from any claims, damages costs or expense, including legal fees, which might arise out of or in connection with such incorporation or use.

FORCE MANJEURE

If the event cannot take place, in whole or in part, because of an act of God, national emergency, war, labour dispute, fire casualty or other unforeseen occurrence or any other cause beyond the control of Promoter or which Promoter is unable to avoid by exercise of due diligence Promoter shall have no obligation or liability whatsoever to Registrant as a result thereof. Additionally, dates and location of events may change art any time at the discretion of Promoter.

OTHER ITEMS

A) The Promoter shall have the full power un the interpretation and enforcement of all registration terms and any further stipulations considered necessary for the proper conduct of Event.

B) Registrant agrees to comply with all pertinent laws, codes, and regulations of municipal or other authorities that affect the event space.

C) Cars entering event’s contest or staying inside the convention centre or similar venues are subject to the regulations set forth by those venues.

D) Sponsors Exclusivity: You may not display or sell products that compete with our sponsors. Please check with Promoter for approved list of companies.

RELEASE AND ACCEPTANCE OF RESPONSIBILITY AND ACKNOWLEDGEMENT OF RISKS

ACKNOWLEDGEMENT OF RISKS

Registrants understand and acknowledge that the activity that they are about to engage in bears certain known risks and unanticipated risks which could result to themselves, and to third parties. Registrants understand and acknowledge this risks may result in personal claims against HOT IMPORT NIGHTS AUSTRALIA or claims against them by other third parties.

ACCEPTANCE OF RISK AND RESPONSIBILITY

Being aware that this activity entails risk to Registrants, and to third parties as a result of their actions, they agree to accept and assume all responsibility and risk for/to themselves arising from their participation in this activity. They agree, covenant, and promise to accept and assume all responsibility and risk from their participation in this activity. Their participation in this activity is purely voluntary and they elect to participate in spite of the risks. This includes notifying all team members of the following:

A) All participating cars must have a (1/4) quarter tank or more fuel

B) You must bump-in together to be displayed together

C) Tools, weapons, food, liquids will be confiscated at the discretion of the venues Security Staff during Vendor/Car Show bump-in and will be held until the end of the event.

RELEASE

Registrants hereby voluntarily release HOT IMPORT NIGHTS AUSTRALIA, its agents, employees, and all other persons or entities from any and all liability, claims, demands, actions or rights of action, which are related to or are in any way connected with their participation in this activity, including specifically but not limited to the negligent acts or omissions of HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, and all other persons or entities, for any claims made by themselves. They further agree, promise, and covenant to hold harmless and indemnify HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, and all other persons or entities from all defense costs, including attorney’s fees, or from any other costs incurred in connection with claims for bodily injury or property damage which they may negligently or intentionally cause to other third parties in the course of their participation in the activity.

Registrants further agree, promise, and covenant not sue, assert or otherwise maintain or assert any claim against HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, and all other persons or entities, for any injury, death or damage to themselves or to their property, arising from or connected with their participation in this activity or from any claim asserted against them by other third parties. By completing the registration form they also fully recognize that if anyone is hurt or property is damaged while they engage in this activity, they will have no right to make a claim or file a lawsuit against HOT IMPORT NIGHTS AUSTRALIA, or its officers, agents, or employees, even if they or any of them negligently caused the bodily injury or property damage.

EFFECT OF THIS RELEASE AGREEMENT

Registrants understand and acknowledge that by registering they have given up certain legal rights and/or possible claims which they might otherwise asset or maintain against HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, and other persons, entities, including specifically, but not limited to, rights arising from or claims for the acts or omissions, negligent in any degree, of HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, and all other persons or entities.

Registrants understand and acknowledge that sole person responsible for making all the required payments and fees HOT IMPORT NIGHTS AUSTRALIA for any HOT IMPORT NIGHTS Show Competition program they have registered to, and take full responsibility for submitting any and all emails, documents, and any form of information whether instructed by phone or in person pertaining to the HOT IMPORT NIGHTS Show Car Competition Category to their team and/or team members and to third parties. They understand and acknowledge that by registering, they have assumed responsibility and legal liability for the claims or other legal demands, including defense costs, which may be asserted by spectators or other third parties against them as a result of participation in this activity. They understand that it is the entire Agreement between the Registrant and HOT IMPORT NIGHTS AUSTRALIA, its agents or employees, or agent of their team, and/or team member or third party. Registrants’ agreement in the registration form indicates that they have read this entire document, understand it completely, and agree to be bound by its terms.
